Consumer Fraud
Fraud is a false representation of a matter of fact, whether by words or by conduct, by false or misleading allegations, or by concealment of that which should have been disclosed, which deceives and is intended to deceive another so that he shall act upon it to his legal injury.
The Federal Trade Commission protects consumers from fraudulent or deceptive claims that mislead consumers, and from harmful business practices that undermine the competitive process. There are also actions that can be taken by state agencies or private individuals to protect consumers.
A defendant may be held liable for misrepresentations made to the persons or class of persons whom he intends or has reason to expect to act or to refrain from action in reliance upon the fraudulent misrepresentation.
